Copyright Laws on Blogs and Social Networks

Copyright laws are something that we don’t think about often when we are blogging or updating our status on Facebook. If you own a website, you own the intellectual content within your website including text, pictures, and even the design (if you created it). You also have fair use rights, which empower you to quote or use excerpts of content from another source. Giving a link and credit to the source does NOT actually mean you have permission though, and the law is actually rather vague. But we in the web world and I would suspect even the ink and paper publishing world, would say if you quote a small piece of material from an article like:

“The distinction between fair use and infringement may be unclear and not easily defined. There is no specific number of words, lines, or notes that may safely be taken without permission. Acknowledging the source of the copyrighted material does not substitute for obtaining permission.”

And then I was to say I got this tidbit of information from: The US Copyright Office and provided a link to said site, well then I covered my butt, and all is good. In actuality it does not cover me, and whether an act of infringement or ‘fair use’ occurred becomes a matter of the courts. The fact of the matter is we all do it and it has become accepted practice.

Recently, the Associated Press website announced that they do not allow bloggers to quote excerpts from AP articles. ( I would provide a quote and source, but don’t want to get in trouble). This lays down a huge precedence if others are too follow and could effectively create a huge bottleneck of information. As of now, RSS feeds, and re-feeds of feeds or other articles is huge business for the Internet. 1000s of sites post title and clips of other articles with links to the originating site for the entire story. As any web developer knows, this actually provides SEO benefits to the original site, and to think the AP wants to prevent this from happening is just plain dumb. Other major blogging sites have actually banned AP article submissions because of this, and we at Inforats agree.

So what of Social Networking sites like Facebook? Well since the owners of the domain are ultimately responsible for the content and are somewhat responsible via ‘contributory infringement’, social sites design their EULA (End-User License Agreement, Terms of Service) in order to protect themselves and their users to a certain degree. The same laws apply for copyright info: If you are caught using a piece of intellectual property from another source, typically, the social networking site is notified, the content is removed, and you will be notified as to why. Done. You fight it, then your in court, but it all depends on the severity and impact.

But protecting your own intellectual rights on Social Media sites is a little more tricky. In essence, you have given up your rights to any content on the site since, in effect, they are using your activities to promote and advertise. YouTube, by practice, makes it extremely easy to ‘share’ a video on any other social site, website, or by email by providing the actual code needed to copy-n-paste. Odds are though, if you posted it on a social network, then you expected it to be broadcast across that network. The more viewers or visitors, the happier you are. Google (and Youtube) will share profits from select publishers, depending on number and quality of materials the user uploads.

So protecting yourself from both committing copyright infringement or from being plagiarized, it really just comes down to common sense. The severity, importance, or monetary value of any piece of copyrighted material and its use is really the deciding factor in the results of some type of infringement. I will continue to practice the safe ‘fair use’ posting method, which means:

�Don’t steal other peoples works and call them your own

�If you use or re-publish someone Else’s information, give credit and link to it. Getting permission is not only a great idea, it is actually the law. But with the standard web dissemination of information, it is not always prudent. Again common sense.

I feel, at least in the realm of web content, it would be a bit easier to define ‘fair use’, and just say only X% of the material can be posted, and credit must be provided with link to original source. Since this guarantees the owner of the content gets a better PR and publicity at the same time. Why not?

Getting Ideas for Your Blogs and Articles

Well to start off with I am not a full-time blogger, I have a day job, and work from nine to six to pay my bills and have a decent life. This leaves me with little to no time to do researches and find good subjects. Taking also into consideration the fact that I am not a natural born writer. Hearing this, it might be hard to believe that I still find time to update my blog several times a week with good information, It might not be the top post, but still good and helpful for many readers. How many of you find yourself in this situation? Below I will list some things that I do to find good subjects and keep my blog rolling.

Blog about something you like and/or enjoy! This is the most important thing that helps me come up with new info every week. It really doesn’t matter if a bunch of blogs already exists out there talking on the same subject, because if you will blog about something you like and enjoy, you will never run out of words. You can narrow down your ideas to subjects that you might have personal expertise with. It will also be easy to come up with new ideas for article every day, because you yourself will be looking for new information about your passion on the web.

Bookmark and visit the top sites from your niche: Maybe this sounds quite strange because maybe all of you are already doing this. In my one year period of blogging I was able to bookmark more than 60 sites, once I had discovered a new sites that I thought was worth visiting. Remember there are a lot of people out there that share your passion, do not hesitate, bookmark blogs that relate to yours and they might the favor. I actually chat with a few of them once in a while to bounce of ideas.

Find ideas from the comments you receive: I don’t really receive a lot of comments, but the ones I do receive are good quality. I think I was able to write more than 10 articles from a 100 through inspiration of other bloggers commenting. Just the other day I wrote an article about Free Tips on Advertising. This idea was generated through a blogger asking me to list a few ad ideas for him.

Subscribe to the blogs you consider worthy: By subscribing to their email list and feeds, you will be able to get much more ideas faster and get informed faster than just searching the blogs. With ideas coming in you should be able to write more articles in a shorter period of time. Of course, you can’t subscribe to the whole list of bookmarked sites but at least the top 10 will do. Choose wisely, try to pick the ones that you could definitely relate to.

Conclusion: These are the things that I am doing to get ideas for new articles, and keep my blog updated. I hope this advice will help some of you. Remember you always need a place to start from, start by looking through other blogs or your older blogs. All ideas don’t have to come from the internet either, chat with a few friends, they might offer some help.

I had my beginnings as a blogger. I was very pleased with my results, and have been a big fan of online business ever since.

Reminder, What You Write on Your Blog Stays on the Internet

The first thing I do in the morning is go through my emails and read my favorite blogs. Not only do I learn, it often triggers information that I can use for my own writing.

Today, a favorite blog had a guest blogger. The subject was how a popular magazine’s articles are “Full of X#@C%G#@”. I took another sip of coffee and “started” to read the blog. Note that started is surrounded with quotes for I could not imagine continuing to read an article that was written by obviously a very angry person. His name was attached.

Shaking my head, I turned to one of other favorite blogs. I read the first paragraph and it said, “We inhaled so much food and booze that none of the clothes we left with fit us on the plane ride back.” Written by the owner of the blog.

My question is, “What were they thinking?” I guess, the real answer is that they were not thinking. Sitting there in disbelief that any professional person would write things like this, I knew I had the subject for my article today.

I decided to keep it short and simple.

How many times does it have to be repeated that anything you write and send out on the internet will stay there?

IT’S THE LITTLE THINGS

  • When using social media, think before you click send.
  • Your character/reputation is either enhanced or discounted by what you put on the Internet.
  • When in doubt, check with your mentor. Would she approve of you making this kind of statement?

Your goal when writing for blogs is to develop your own interesting, informative, and clear writing style. Knowing that you will be using your own expert knowledge to interest and inspire your readers.

Here are 5 Tips on Writing for Blogs:

1. Update, update, and more updating

Blogs that attract the most readers, and keep them coming back, are the ones with regular updates. If you are serious, be prepared to spend some important time on your own writing and posting to your blog every day, at least a minimum of 3 times a week. Get into a routine, a habit!

2. Developing your own style

When writing blog posts for your small business, or personal blogs, keep a specific target audience in mind. This means you will be thinking of someone you know well. You really do need to know your target audience. Get a person in your mind that represents your audience. This is your targeted customer! Become well acquainted with the person. That’s who you want to read your blog. Then write for that person.

3. Present the need

Most people will not read what you are writing for blogs, if they don’t feel they need to know what you’re writing about. Your title and the first paragraph of your blog post need to show your target audience why reading what you write in your blog posts are important to them. Tell them what problem you are solving, what needs you are trying to meet, what they’ll learn and how it will make their lives better. They will want to know what’s in it for them. Do this and you’ll increase the likelihood of them reading through your full post and coming back.

4. Choose something basic to talk about

Like “5 Things You Need to Know When You Start Writing for Blogs”. Sometimes it is the most simple and basic tips that people want. Write for the beginner type of reader and you might find you connect with more of your targeted customer. In other words, put it in laymen’s terms.

EX: Instead of assuming someone knows what SEO means – spell it out – ‘Search Engine Optimization – optimizing your blog’s online visibility so that search engines like Google can locate your site.’ Remember, that you need to put your targeted audience first when you are writing for blogs. It is your readers that you want to interest and keep coming back. SEO helps them find you. Your writing content and expertise keeps them coming back.

5. Break it down into steps

I always say step by step. You need to learn how to communicate in bite sized and achievable steps. Use screenshots and examples to show processes. Post a step by step process via audio or video to explain further. Write out the steps, if that explains it better, when you are writing your blog posts.

Even if you are a “novice” writer, you can be interesting enough to attract your own audience and keep them coming back. And, the more you write, the more your own style will emerge.

So – Practice, practice and more practice…

Using Copyrighted Material in Blogs and Forums

Recently, a relatively new member of Ecademy, one of the online communities I participate in regularly, posted an article from my About.com site in his blog without a link and proper attribution. I don’t believe that he was trying to claim authorship or doing anything malicious, but he caught some pretty heavy flak about it from other members. What he did was “wrong”, but unfortunately all too common, not because people are willfully stealing intellectual property, but because they don’t know any better.

That may seem shocking to those of you who know (or think you know) the proper care and handling of copyrighted material, but in some discussions about the topic on a couple of forums, I learned that a common sentiment about articles on the Internet was, “Spreading the articles around just helps promote the author. Why wouldn’t someone want their articles posted in discussion forums and blogs, assuming proper credit is given? It’s doing them a service.”

That may or may not be true, depending on what the author’s business model is. Ultimately, though, how you can use someone else’s writings is not your decision, it’s the author’s. Here are a few basic concepts and some resources to help you stay within the law, as well as build respectful relationships with the people whose content you find so valuable:

Blogs posts are copyrighted by default. The #1 rule to remember is that, by default, posts to a blog (or to a discussion forum, for that matter) are copyrighted material, and the author owns the copyright. Just because it’s “public” doesn’t mean it’s “public domain”. That means that it is subject to all the restrictions on copyrighted work, i.e., it can’t be freely copied and used even with proper credit without either a) the permission of the author or b) within the context of “fair use”. The owners of the site, e.g., Ecademy, may also have rights to use it as part of the user agreement, but no one else does.

Fair use is a concept that allows limited use of copyrighted material, generally for the purposes of criticism, education, satire, etc. And no the “education” umbrella doesn’t allow you to use works in their entirety. There are no hard-and-fast guidelines as to where the line is drawn, but using a work in its entirety is never allowed, whether it’s a four-line poem or a four-page article. Similarly, an entire chapter from a book would also be a copyright violation. You can use excerpts, but not “complete” anythings: chapters, articles, posts, poems, etc. You can see a quick summary of “fair use” at the U.S. Government Copyright Office or get more in-depth information at the Stanford Copyright & Fair Use Center. The Electronic Frontier Foundation provides some great legal resources for bloggers, including Bloggers’ FAQ – Intellectual Property.

There are exceptions. Sometimes, bloggers or article writers make things available for use in their entirety. This may be done through an express permission statement in the byline of the article or on the blog site’s footer, something to the effect of “This article may be reproduced in its entirety so long as this resource block is kept intact and included in the article.” Many people now use a Creative Commons license of some type to permit broader use than allowed by copyright, but still under the control of the creator.

Don’t make assumptions. You can’t assume that you know what the allowable use is of a particular post or article. For example, the content I post on my About Entrepreneurs site is all copyrighted and may not be reposted without permission. On the other hand, what my coauthor and I post on TheVirtualHandshake.com, the companion site for our book, is under a Creative Commons license and can be freely reposted with proper attribution and a link. Why the difference, you ask? Simple economics. On About.com, the revenue model is advertising-based, and I get paid based upon page views. Post the content elsewhere and I don’t get paid on it, at all. On TheVirtualHandshake.com, it’s all about positioning ourselves and promoting the book. Post the content wherever you want — if it’s any good, it eventually drives people back to us for the book and maybe more.

Proper respect for intellectual property = good networking. Good networking means learning about other people’s business. For those of us who write professionally, our content is our product. Learning about our business means learning how to properly refer people to us, just as it would for anyone else. The simplest solution is to always use an excerpt and a link, never content in its entirety. That will pretty much always constitute fair use, and will always be appreciated by the content creator.

This is not the first time this has happened to me, as you might imagine. I always approach it as a networker, not a litigant. “Are you aware that this is copyrighted material and may not be re-posted in its entirety, even with proper attribution? I’d be happy for you to use a short excerpt and a link. Please edit it as soon as possible and inform me when you have made the correction.”

Think win-win.
